Legal Fee Methods
1. Flat Rate
Criminal defense matters, Wills, Trusts, Powers of Attorney and
various other civil matters often involve a single, flat-rate fee
to the client. The flat fee depends on the seriousness, time, and
complexity of the matter involved.
2. Contingency Fee
A contingency fee is based upon a percentage of money a client collects
as the outcome of a case. This method is used mostly in personal injury
cases.
3. Hourly Rate
A set hourly rate is typically used in Family Law, some Estate Planning
such as Probate, Guardianships and Conservatorships, DUI's, Traffic
Tickets, and some may be used in Criminal Defense and Civil Litigation
cases. When this method is used, a retainer fee is required. Use of
this fee method depends on the seriousness, complexity and time that
may be required in the matter. Many clients prefer a flat fee so they
know and can plan on the cost of representation, if the attorney is
willing to work based upon a flat fee. The client agrees to be billed
in 1/4 hour increments. All initial consultations are free. They do
not include providing any legal advice and typically last about 20
minutes to meet, share the legal issue and determine whether the attorney
will be retained or take the case.
